If They Didn’t Read Me My Rights, Can My Case Be Dismissed?

Not, necessarily; however, it could impact the admissibility of any statements or confessions you

made during a custodial interrogation. The prosecution can still proceed with other evidence,

such as witness testimony or physical evidence. 

What is a custodial interrogation?

You are in police custody and being questioned, and you are not allowed to leave. 

What are your Miranda rights?

You have the right to remain silent and the right to an attorney. These are important fundamental

rights during a custodial interrogation. If police fail to read you your Miranda rights before

questioning you, any statements you make during that interrogation may be inadmissible in

court.
